Representing Creditors

Our firm represents banks, financing concerns, industrial companies and other enterprises in commercial debt collection efforts.

Whenever possible, we attempt to get results without resorting to litigation. With the creditor, we analyze the debtor's situation to develop the best approach — often negotiating a debt repayment plan with the debtor. We have found that this approach can produce an acceptable outcome for the creditor while preserving the creditor's commercial relationship with the debtor. If necessary, we will go to court to get a judgment and undertake a collection effort.

Quick action is a hallmark of our commercial collection practice. When deciding on a course of action, we pay close attention to issues of timing and the competing interests of other creditors who have claims against our client's debtor.

Representing Debtors

Lassiter & Sperati, PLLC, represents North Carolina individuals and commercial entities who face collection actions by their creditors. When a collection action has not yet started, we can seek to negotiate a debt settlement plan with the creditor. When a lawsuit is unavoidable, we aggressively defend our client's interests in court. Our attorneys are very familiar with applicable U.S. codes and use all available federal exemptions to protect as many of our client's assets as possible.
